CARLSBAD, CA - NobelBiz Inc. prevailed in its patent infringement lawsuit against Global Connect, LLC and TCN, Inc. in the Eastern District of Texas, Tyler Division. According to the company, the Honorable Robert W. Schroeder, III presided over the one-week jury trial that started on September 8.

The jury unanimously found that defendants Global Connect and TCN directly and indirectly infringed NobelBiz’s US Patent Nos. 8,135,122 and 8,565,399‎. The jury also unanimously found that NobelBiz’s patents were not invalid, and that the infringement was willful.

“We are extremely pleased – though not at all surprised – with the jury’s verdict,” said Rich Mahfouz, the CEO of NobelBiz. “Ten years ago NobelBiz invented a game changing telecommunications feature, LocalTouch®. NobelBiz has worked hard and expended significant resources to develop and to protect our intellectual property rights surrounding LocalTouch®. The jury’s verdict here is the culmination of three and a half years of ethical, intense and zealous litigation by NobelBiz. It reaffirms the strength of our patents, and our commitment to protecting and defending NobelBiz’s intellectual property.”

Pursuant to the verdict, the jury awarded NobelBiz damages amounting to almost $1.5 million. The jury’s unanimous finding of willful infringement also means that the Court may treble these damages’ figures. Attorney’s fees, costs, pre- and post-judgment interest and injunctive relief also will be considered in short order.

Ralph Dengler, Andrew MacArthur and Gianna Cricco-Lizza of Venable’s NY office, and Bill Hector of Venable’s San Francisco office led the NobelBiz legal team. Elizabeth DeRieux of Capshaw DeRieux served as the team’s Texas counsel.
