CopyTele Files Patent Infringement Lawsuits in Connection with Windows Patent

MELVILLE, NY - CopyTele Inc. (CTI), a company specializing in patent monetization and patent assertion, announced in a press release that its wholly owned subsidiary, J-Channel Industries Corporation, filed 8 patent infringement lawsuits in the Federal District Court for the Eastern District of Tennessee, in connection with its patented J-Channel Window Frame Construction technology. Defendants in the lawsuits consist of retailers, window manufacturers, and home builders, including Lowe’s Companies, Inc., Clayton Homes, Inc., Pella Corporation, Jeld-Wen, Inc., Atrium Windows and Doors, Inc., Ply Gem Industries, Inc., RGF Industries, Inc., Tafco Corporation, Kinro Manufacturing, Inc., and Elixir Industries, Inc.

Robert Berman, CTI’s President and CEO stated, “Our inventor is a former window manufacturer that was forced out of the business by a consortium of larger, more powerful competitors, who misappropriated his J-Channel technology.

After licensing the technology to a few manufacturers, the original J-Channel patent was invalidated in patent litigation over ten years ago due to discrepancies in the claim language. Following that litigation, the inventor fortified the claim language to eliminate the discrepancies, and the patent office re-issued the patent. As a result, we now have a much stronger patent, an established royalty rate based upon the previous licenses, and widespread infringement for J-Channel technology which has become an industry standard.”

J-Channel functionality allows for easier and faster installation of windows commonly used in modular, manufactured, and conventional homes. Estimates indicate that approximately 40 million windows are sold in the US each year.

Since announcing its new business model in October of 2012, CopyTele now has 12 active lawsuits across 4 patented technology areas including E-Paper Electrophoretic Displays, Nano Field Emission Displays, Key Based Encryption, and Window Frame Construction.
