InSite Vision Wins Patent Interference Litigation

ALAMEDA, Calif. - InSite Vision Incorporated today announced in a press release that a United States Patent and Trademark Office (USPTO) panel of judges found in favor of the Company in its patent interference litigation with the University of California, San Francisco, and have confirmed the inventorship of InSite Vision's US Patent Nos. 6,239,113 and 6,569,443 protecting AzaSite®.
"We are extremely pleased that the USPTO has concurred with our long-held position in this case," said Timothy Ruane, InSite Vision Chief Executive Officer. "We now turn our full attention to maximizing the continued commercial success of AzaSite® in the market place and to advancing our clinical trial programs, including those within the AzaSite® franchise."
In 2009, the Regents of the University of California claimed that the inventions contained in the patents were made by a former employee of the University alone and without collaboration with InSite Vision, the assignee of all the named inventors. The USPTO has now entered judgment against that claim.
